Dallas Trucking Company Secures Case Dismissal in Wrongful Death Lawsuit

DALLAS – A Texas district judge has dismissed all claims against a large Texas-based trucking company in a wrongful death lawsuit stemming from an August 2016 accident that killed a man and injured another.

On Sept. 9, 192nd District Court Judge Kristina Williams granted the summary judgment order for the trucking company with prejudice three years after the original lawsuit was filed. The judge also ordered all costs be taxed to the plaintiff.

Sargent Law attorneys secured the defense win for the company, which was facing negligence damages for a collision caused when a car struck the rear of the plaintiff’s tractor-trailer that was stopped for a mechanical breakdown on Interstate 45.

“While we are saddened by the loss of life and the injuries in this accident, our client was not responsible for the accident and we were able to show that in court,” said defense attorney David Sargent of Sargent Law.

In their request for summary judgment, Sargent Law attorneys argued that the trucking company could not be liable for negligence because the tractor-trailer was not owned by the company; the driver admitted in his deposition that he was not an employee or contractor of the business; and the company did not broker the load on the trailer.

The case was filed under Cause No. DC-18-10652, in the 192nd Judicial District Court in Dallas County.
